U.S. H-1B Visa Program Enters 2025 with Faster Processing and Broader Access

U.S. employers and international talent are bracing for an unusually dynamic H-1B season after a series of policy tweaks aimed at speeding decisions, widening eligibility and easing travel headaches for current visa-holders. The Department of Homeland Security confirmed that the electronic registration window for FY 2026 will open in early March, but observers say demand will once again outstrip the statutory 85,000-visa cap, forcing another lottery draw—much like the unexpected second lottery USCIS was obliged to run for FY 2025.

Key policy moves shaping the 2025 landscape

  • Graduate & DACA fast-track.  Guidance released in June–July 2024 instructs consular officers to prioritise U.S. college graduates, including Deferred Action for Childhood Arrivals (DACA) recipients, and to apply new waiver criteria that can shave weeks off normal processing times.

  • Domestic H-1B renewal pilot.  Rolled out in 2024 and continuing this year, the pilot lets certain workers with visas originally issued in India or Canada obtain a fresh visa stamp by mail—eliminating costly trips abroad.

  • Premium processing acceleration.  While the 15-calendar-day guarantee is unchanged, USCIS reports an average turnaround of 0.4 days for premium petitions filed so far in 2025, reinforcing the value of the US $2,805 surcharge for time-sensitive hires.

  • Higher upfront fees.  Employers must now pay US $215 just to enter the electronic lottery. If selected, filing Form I-129 costs US $780 (or US $460 for small businesses and nonprofits), plus anti-fraud and training surcharges.
